Should Canon Have Another Digital Camera Class Action Lawsuit on Their Hands?

The subject of product design defects is an interesting one. Should manufacturer be held liable for any and all problems to a product after it has been sold to consumers and a wide-reaching issue has been diagnosed? If the defect is minor, and has little influence on the operation of the product should they be forced to fix it? Who decides if a defect is indeed 'minor ' and how if the whole process best be handled?

There are one or two examples lately of consumer digicams that have well-known defects, but the makers' employees when asked about the issue will state they have not heard about it before. All of the major camera makers are guilty of this, so it looks to be the policy of each company to deny knowledge of a problem unless forced to do so legally.

When a big issue appears with a product, and the maker is aware of the issue, they should fix it. That does sound right. As an example, it is announced that the Ford Motor Company decided it would be less expensive in the long run to NOT recall the "Pinto" model cars that had a hefty rate of catching aflame and exploding when in certain accidents due to poor design. Rather than fixing the difficulty before there was accidental, they made a decision it would be less expensive to settle suits against them for injuries and deaths caused by the design instead. Obviously in this example, the maker should have corrected the auto before there was any injury or deaths in the 1st place.

When it comes to smaller electronics, when is it worth it to take the company to court and try to force them to fix the product? As an example, the Canon SD790 hand strap screws almost always vibrate themselves loose and drop out of the camera. This will cause the side trim of the camera body including the handstrap itself to fall off, leaving a giant gaping hole in the side of the camera for dirt and debris to enter simply.

The screws should be secured with something like "Locktite", and can be bought online for roughly $7 including shipping for a pair. In this situation should the manufacturer pay each buyer of this camera $7 or send them a couple of screws and some "Locktite" to secure them? We both know that the only way that would occur is if they were legally made to do so. The problem is, a legal case will take years to settle, and the only folks who truly benefit from it are the barristers, and no-one else.

A lawyer in a case like this, representing many thousands of consumers, could stand to earn a hundred thousand dollars or more for their time, while the patron sees just $7 each. Is this fair? Is this justice? The case could take forever to settle, and in the meantime all you would like is a screw repair kit for your digital camera!

A new defect now starting to be seen is the fact that the Canon Powershot G9 camera also has screws that work themselves loose and disappear over time! Now there are many unhappy Canon customers looking for Canon G9 screws as well! Is there no end in site?

Indeed the honorable thing for the maker to do would be to own up to the difficulty and supply a solution for either a very nominal cost to the buyer or no charge at all . This may go a long way to increase consumer confidence in the maker as well as keeping that client trustworthy to the brand so making the money back through future purchase. Unfortunately it appears like established companies might be too nervous about today to consider the future.
